2 Application of the terms and conditions

An order placed by the Customer implies they accept all the present terms and conditions.This applies to all orders on SPARTOO.NET. It constitues a contract between SPARTOO.NET and the Customer. The Customer waives, in particular, the right to rely on any contradictory document, which would be binding on SPARTOO.NET.

These general terms and conditions of sale may be subject to subsequent changes. The version applicable to the purchase of the Customer is the one valid on the website at the date of the order. Changes to these terms and conditions are binding on users of the SPARTOO.NET website from the time they are posted online and can not be applied to transactions processed previously.

All site users must respect the general conditions of sale.

3 Validity of our offers

Our offers are intended solely for consumers with a delivery address outside of Europe and China.
Items displayed on the site are available until depletion ofstock.
In the event of debit or payment of an order for an item which is unavailable,SPARTOO.NET will inform the Customer by email and offer a credit note or refund within 15 days. SPARTOO.NET will inform the Customer by email if the order contains an item which is not available.

4 Presentation of products

All products for sale are described and presentedas accurately as possible.The Customer is obliged to refer to the description of each product in order to know the properties and the essential characteristics. The Customer is obliged to take cognizance of this before any order is placed. The choice and purchase of a Product is the sole responsibility of the Customer.
However, SPARTOO.NET cannot be held responsible for any errors or omissions which may occur in this presentation.Any Customer is advised to inform SPARTOO.NET of any errors in the designation of a product.

5 Account creation

To place an order, the customer must first have created a customer account, at the time of his first order. He/She must complete a form containing the following information: E-mail address, civility, surname, first name, sex, date of birth, full delivery address, telephone number. E-mail address, title, surname, first name, sex, date of birth, full delivery address, telephone number. On this occasion, the Customer creates a password that is personal and for its unique use. Any disclosure to third parties is prohibited.
The Customer undertakes to provide complete and accurate information. Any usurpation of identity or false identity may lead to the closure of the account and may lead to prosecution.Any multiple entries, use of the account by several persons or other fraudulent actions may result in the termination of the registration.
The Customer acknowledges having the capacity required to contract and acquire the products offered on the SPARTOO.NET website.
SPARTOO.NET refuses any sale to minors under 16 years of age without the prior authorization of the parents which will be systematically required.

6 Prices

Prices are in US Dollars excluding VAT. SPARTOO reserves the right to modify its prices at any moment, but the products are invoiced at the price indicated when the order is registered.

The rates take into account any reductions granted on the site SPARTOO.NET. These prices are firm and not revisable during their period of validity, as indicated on the SPARTOO.NET site, SPARTOO.NET reserving the right, outside this period of validity, to modify the prices at any time. They do not include the costs of processing, shipping, transport and delivery which may be charged extra, if so specified on the sites. The payment requested from the Customer corresponds to the total amount of the purchase, including these costs.
An invoice is issued by SPARTOO.NET. It can be downloaded from the website where the order was placed.


VAT and customs duties

The price of the products is indicated without VAT. Any order placed on the Site and delivered may be subject to any taxes and customs duties that are imposed when the parcel reaches its destination. These customs duties and any taxes linked to the delivery of an article are at the Customer's expense and are the responsibility of the Customer.
SPARTOO.NET is not required to check and inform customs duties and taxes. By ordering on the Site, the Customer is considered the importer and must comply with all laws and regulations of the country where the goods are received. Customers should be aware that cross-border deliveries are subject to opening and inspection procedure by the customs authorities.


7 Order and Secure Payment

7.1 : Order

The customer validates his order as described below. This validation implies acceptance of these SPARTOO.NET general conditions of sale. Customers interested in any article displayed on the website SPARTOO.NET follow the following steps to place an order.
- Choose size and color
- In the shopping bag, check the specificities of the order (color, quantity, size, price, etc ...) with possibility of modification, addition or even deletion of certain items.
- At the time of its first order, fill in an account creation form with a password.
- If the Client receives a special offer, first enter the code assigned to him in the field provided for this purpose.
- Choose the method of payment, type of delivery, delivery address.
- After having validated its method of payment, definitively and irrevocably validate the order with the effects indicated below. Any validated order results in a payment obligation.
- An email confirmation of order is sent valid final sale after receipt of the full price (which is not a deposit payment). The Products are reserved for 7 days.

Any validated order results in a payment obligation.

The transfer of ownership of goods sold by SPARTOO.NET to the benefit of the Client, will be made only after full and regular payment by the latter, and this whatever the delivery date of the products. The retention of title clause does not preclude the risk of loss or deterioration of the goods to be borne by the Customer as soon as the order is placed.

It is the Customer's responsibility to verify the accuracy of the order and to report any errors immediately.


7.2: Payment

  • Payment by credit card
    The Customer shall provide the number of his / her bank card associated with the expiry date and the security code.
    He/She finally validates his order by clicking on the "Confirm" button. To secure the payment, in some cases, payment confirmation is only done after entering a 3D-Secure code provided by the bank. By checking the Remember box, the Customer agrees that the credit card number associated with the expiry date will be retained for future purchases.
  • American Express Payment
    The American Express Card is accepted on SPARTOO.NET.
  • Paypal
    For anyone with a Paypal account, payment is made online, through that account, simply by entering the Paypal email address and password.
    Thus, the financial information of the Client is never communicated to SPARTOO.NET. PayPal encrypts and protects the card number once and for all.
  • Payment by Gift Card
    Payment by gift card is possible. The Customer will have to enter the number of the card in Gift Card section . If the amount of the order is greater than the amount of the gift card, the Customer will have to complete the payment by another means of payment. If the amount of the order is less than the amount of the gift card, the Customer may use the balance for a next order within the period of validity of the gift card.

7.3 : Payment Default

SPARTOO.NET reserves its right to refuse to make a delivery or to honor an order emanating from the Customer who has not totally or partially settled a previous order or with which a dispute of payment is in the course of administration or it has a risk of fraud.

Any discharge of bank card, abusive dispute with Paypal will lead to a recovery procedure by the SPARTOO.NET company. For all recoveries of unpaid amounts, SPARTOO.NET will apply penalties and, in addition, collection costs may be payable.


7.4 : Payment Verification

SPARTOO.NET controls all the orders that have been validated on its website. These controls aim to protect SPARTOO.NET from abusive practices: identity theft, payment fraud. SPARTOO.NET services will have to ask any customer, all the parts required to unblock the order: proof to confirm the address and identity of the person ordering, etc ...

If these parts are not received within 7 days, the order will automatically be canceled.

Any receipt of non-compliant documents will also result in the cancellation of the order.


7.5 : Secure Payments

In order to ensure payment security, the SPARTOO.NET site uses a secure payment service. This service integrates the SSL security standard. The confidential data (the 16-digit bank card number, the expiry date and the security code) are directly transmitted encrypted on the bank's server without transiting on the physical media of the SPARTOO.NET servers. When the order is validated, the payment request is routed in real time to the secure payment manager. The latter sends an authorization request to the bank card network. The telepayment manager issues an electronic certificate which will be proof of the amount and date of the transaction.

8 Sign up / Sign in

All customers who have already made a purchase at SPARTOO.NET can choose a password which will allow them to place subsequent orders without having to complete the required information forms again.The Customer who has already subscribed is recognised on the site as being a customer at SPARTOO.NET.
The SPARTOO.NET customer's password is strictly confidential and personal.It must never be disclosed to a third party.
In the event the SPARTOO.NET customer has lost or has forgotten his/her password, he/she should contact SPARTOO.NET customer service at this address adriana@spartoo.net and a new password will be issued within 48 hours to replace the previous one. In order to facilitate the identification of the Customer by provision of both the e-mail address and password, the Customer expressly authorises SPARTOO.NET to place a "Cookie" on the customer's computer with the sole purpose of facilitating the above-mentioned identification.

9 Delivery operated by SPARTOO.NET

The supposed delivery costs, delays and methods are calculated according to Customer address on secure payment page
Delivery times given are in reference to the order date, and presented in working days (Saturdays, Sundays and bank holidays are not taken into account for calculation of delivery time). In case of force majeur, Spartoo can not be held responsible for any delay in delivery. The indicated delivery times do not include customs delays.


10 Money-back guarantee

All items purchased on SPARTOO.NET site may be subject to a return with "Money back guarantee" if client will not maintain a product for legitimate reasons: the product does not appeal, is not the right size, not the expected color, etc .... SPARTOO.NET products may be exchanged or refunded for the amount paid. In case of exchange, if the price is higher, the exchange can only take place after receipt of the additional payment.
To be accepted, returns must meet the following specifications: To be accepted, returns should meet the following conditions:
- The product should not have been worn outside. It should be in new condition
- The returned product (s) must correspond to the product (s) delivered,
- Should be returned in the original packaging and in good condition
- The product should be returned within 30 days of delivery of your order
- Empty packaging will be refused for any exchange or refund,
- Follow the indicated return procedure

Sign in to your Spartoo customer account with your email address and your password and go down to the section "my returns" to complete a return request.

Step 2 : Receive label
You will receive an email with the return address to send the parcel to at your charge.

Step 3 : Give the return parcel to the transport service
Give your parcel to the transport service of your choice.
Please remember to keep your proof of postage receipt.
Your return will be processed within 7 to 10 working days, depending on the return delivery time.

11 Delivery and despatch problems

11.1: Returned as "UNDELIVERABLE":

Consignments returned to Spartoo by the transporter with the following remark: Undeliverable. Once we have received and accepted the undelivered consignment,SPARTOO.NET will contact the customer to propose a new shipment if the product is still available or to offer a refund.
SPARTOO.NET reserves the right to reimburse an order and not to re-ship it if multiple "UNDELIVERABLE" orders have been identified.


11.2: Returned as "NOT CLAIMED":

Consignments which have not been claimed by the customer within the time limit imposed by the carrier.Once we have received and accepted the undelivered consignment,SPARTOO.NET will contact the customer to propose a new shipment if the product is still available or offer a refund. SPARTOO.NET reserves the right to reimburse an order and not re-ship it if multiple " NOT CLAIMED" orders have been identified.


11.3: Returned as "REFUSED":

The consignment has been refused during delivery attempt. Once we have received and accepted the undelivered consignment, a credit note will put in the customer account within 72 hours following receipt of the undelivered consignment. The Customer may request a refund and thus cancellation of the credit note directly in our "CUSTOMER SERVICE" section on SPARTOO.NET.

In the event a consignment is returned to Spartoo as " UNDELIVERABLE ", "NOT CLAIMED ", or "REFUSED", SPARTOO.NET cannot guarantee reservation of the ordered items and may need to reimburse the order if the product(s) is/are not available.


12 Responsibility

For all stages - from access to the site, browsing, filling in forms, placing an order, delivering items or any other service, SPARTOO.NET only has a reasonable endeavours obligation. SPARTOO.NET cannot be held responsible for any inconvenience or damages arising from the use of the Internet outside the diligence and precautions taken by SPARTOO.NET.
In particular, SPARTOO.NET cannot be held responsible for any disruption of service or any external intrusion or presence of a computer virus. Similarly, any event which qualifies as force majeure in the legal sense by the French Court of Appeals fully exonerates SPARTOO.NET from all responsibility. Customers benefit from guarantees offered by the brands listed on the site.

13 Intellectual Property

All elements on the SPARTOO.NET site, visual or audio, including the underlying technology, are protected by copyright, brand and patent law.
They remain the exclusive property of SPARTOO.
All hypertext links forwarding to SPARTOO.NET and in particular use of framing, deep-linking, in-line linking or any other deep linking technology is strictly prohibited.
In all events, any link, even authorised, must be removed when requested by SPARTOO.NET.


14 Personal Data

14.1: The collection of personal data

When creating a Customer account and when ordering on the SPARTOO.NET site, SPARTOO collects personal data. The person responsible for collecting the data is SPARTOO SAS, Simplified Joint Stock Company, registered under number 489 895 821 RCS GRENOBLE, whose registered office is located at 16 rue Henri Barbusse 38100 Grenoble - France. SPARTOO has declared to the CNIL (French data protection organization) the protection of the personal data of Clients and its fight against fraud: declaration n ° 1182432.

The term "personal data" means all data which identify an individual, including, for example, surname, first name, telephone number, date of birth, gender, e-mail address, postal address and any information the Customer chooses to communicate SPARTOO.NET about it.

For the purpose to fight against fraud referred to below (Parts 2 and 3), SPARTOO.NET is also likely to retain information relating to transactions on its sites, including a truncated portion of the credit card numbers used to make the so-called transactions and their date of expiry.


14.2 : Purposes of data collection

The personal data is collected to meet one or more of the following purposes:
- manage the orders on the Site,
-developing trade statistics, conducting market and behavioral studies,
-constitute and manage prospect files, including technical operations such as standardization, enrichment and duplication,
- carry out operations relating to the management of customers,

14.3: Recipients of collected data

Only SPARTOO.NET and the external companies contractually linked to SPARTOO.NET for the processing of the Customer's order have access to the information communicated. The categories of persons who will have access to personal data within the company SPARTOO are, within the limits of their respective attributions, the commercial, administrative, technical and control departments (auditors, Internal control procedures, etc.)

Personal data may also be sent to public bodies solely for the purpose of meeting legal obligations, auxiliaries of justice, ministerial officials and bodies responsible for collecting debts.

All necessary precautions are taken to safeguard the security of personal data and in particular to prevent them from being deformed, damaged or unauthorized by third parties.

SPARTOO The company reserves the right to commercially sell the data it has collected on the site if the Customer has selected the words "I want good deals on Spartoo partners."
The company SPARTOO may then have to transfer the data to foreign companies. It undertakes to communicate these data only to foreign companies that have the same level of data protection as France and the European Community.


14.4: Retention of personal data

The collected data is kept for a period of five years from the last transaction carried out on the site or from the last update of the customer account, except truncated credit card numbers and their expiry, which are only kept for a period of thirteen months in order to fight against fraud and in the Premium Service. In the event of an explicit agreement by the Customer who has ticked the "Remember" box, SPARTOO.NET is authorized to keep bank details in order to simplify future regulations. These data are retained for a period of thirteen months from the last transaction or last update.
In the absence of a new transaction or update of the Client account during the five-year period, the Customer data is automatically deleted.
The security code is systematically destroyed after an effective, complete and undisputed transaction.


14.5 : Cookies

SPARTOO.NET measures the number of page views, the number of visits and visitor activity on the site and their frequency of return using the use of "cookie" technology.
A cookie does not identify the Customer. It records information relating to the navigation of the Customer's computer on the SPARTOO.NET site (the pages consulted, the date and time of the consultation, etc.) and to be able to read them during subsequent visits.
Data collected by cookies are strictly for internal use only and are never transmitted to third parties.

The use of cookies, clean or third party, not necessary for the operation of the site requires an express consent of the Client. The manifestation of the consent or the opposition to the use of cookies is made by a setting of the browser in an appropriate way.

Some cookies known as "advertisement cookies" allow to follow the navigation of the Client and to register the products seen, and then within a maximum of 90 days to present banner advertising related or not, with the navigation history. These cookies are linked to the Customer's internal profile (without being able to identify it).


14.6: Right of Access and Rectification

When the Customer communicates personal data, it gives express consent for the collection and use of personal data.

14.7 : Reciprocal Obligations

The Customer agrees to respect, during any data collection or communication of data from SPARTOO.NET not to disclose them and to keep them only for his personal use. SPARTOO.NET reserves the right to refuse to communicate the data, such as asking the Customer to remove them.

15 Games and Competitions

Gift cards or vouchers are in the form of discount coupons with a unique code. Gift cards and vouchers are non-refundable and can not be subject to monetary consideration. However, products purchased with gift cards or vouchers may be exchanged and be credited in the event that they are not suitable. The gift card or voucher will be re-credited and must be used during their period of validity.
They are not combinable with other promotions or other coupons.
